By downloading or using HockeyBeats, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app.

Please read these Terms, our Privacy Policy and any other terms referenced in this document carefully.

Rights and Restrictions

Rights Granted. HockeyBeats LLC grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use the Application solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.

Restrictions. You’re not allowed to copy, or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, reverse-engineer, decompile, disassemble, modify, translate the app into other languages, or make derivative versions. The app itself, and all the trademarks, service marks, trade names, logos, copyright, database rights and other intellectual property rights related to it, are sole property of HockeyBeats LLC. The Agreement does not grant you any rights to use any HockeyBeats Brand Features whether for commercial or non-commercial use. You may not use the HockeyBeats logo or any other graphics or text to imply an endorsement or support by HockeyBeats LLC without written permission.

Resell. You agree not to, and you will not permit others to, license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Application or make the Application available to any third party.

Phone Access. The HockeyBeats app stores and processes music data that is stored on your phone in order to provide our service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the HockeyBeats app won’t work properly or at all.

Stored Music. You are solely responsible for Music Content you import to your Music Library, including ensuring that it has been lawfully acquired and that it is free from any malware, viruses, Trojan horses, spyware, worms, or other malicious or harmful code.

Playing Music in Public. The right to perform or play a song in public is the exclusive rights of the copyright holder. Playing music in public may require copyright clearance and obtaining permission from the composers of that music. Determining if and what licenses are needed for your case is your sole responsibility. HockeyBeats LLC does not provide any legal or non legal advice.

Internet Connection. You should be aware that there are certain things that will not take responsibility for. Certain functions of the app will require the app to have an active internet connection (e.g. links to the privacy policy and terms & conditions). The connection can be Wi-Fi, or provided by your mobile network provider, but cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Usage. Along the same lines, HockeyBeats LLC cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the service, cannot accept responsibility.

With respect to HockeyBeats’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. HockeyBeats LLC accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

Updates. HockeyBeats LLC is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

At some point, we may wish to update the app. The app is currently available on Android – the requirements for this system (and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. HockeyBeats LLC does not promise that it will always update the app so that it is relevant to you and/or works with the Android version that you have installed on your device. However, you promise to always accept updates to the application when offered to you. We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you.

Termination

This Agreement will terminate immediately, without prior notice from HockeyBeats LLC, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the Application and all copies thereof from your mobile device or from your desktop.

Upon termination of this Agreement, you shall cease all use of the Application and delete all copies of the Application from your mobile device or from your desktop and the rights and licenses granted to you in these terms will end.

Additional terms relating to links to and from third-party websites

HockeyBeats LLC Sites and Services may contain links to other websites that are not under HockeyBeats LLC ’s control. The appearance of, or reference to, any information, materials or other content on, or a link from, a HockeyBeats LLC Site or Service does not constitute an endorsement, express or implied of any products or services provided by entities other than HockeyBeats LLC . HockeyBeats LLC maintains these links solely for your convenience, and you understand and agree that you access them at your own risk. HockeyBeats LLC cannot guarantee the accuracy, completeness, efficacy, or timeliness of information located on these other websites. You understand that these other websites may have terms and conditions that are different from these Applicable Terms and Condition, and that you are responsible for your compliance with their terms and conditions. Any comments or issues arising from access to these other websites regarding any of these other websites should be addressed directly to the operator of the website.

Changes to This Terms and Conditions

HockeyBeats LLC may update the Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. HockeyBeats LLC will notify you of any changes by posting the new Terms and Conditions on this page. These changes are effective immediately after they are posted on this page.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HockeyBeats LLC AND ALL OWNERS OF THE CONTENT MAKE NO REPRESENTATIONS AND DISCLAIM ANY WARRANTIES OR CONDITIONS OF SATISFACTORY QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. NEITHER HockeyBeats LLC NOR ANY OWNER OF CONTENT WARRANTS THAT THE HockeyBeats SERVICE IS FREE OF MALWARE OR OTHER HARMFUL COMPONENTS.
